There are two categories of fictitious (invented) personages. First group includes animate personages created by actor. By the way it`s necessary to stress difference between actor and image created by him. If the personage is associated with the actor he can protect his own personal rights such as rights of using his image in advertisement.
If the fictitious image become popular the actor can make climes in the case when image is associated with him.
However mostly authors and producers have rights for personages.
The second group includes inanimate personages from movie and cartoons such as Mickey Mouse. As a rule the authors and producers have rights for personage.
As animate well inanimate personages have original and specific characteristics.
Personages can be protected if they have visual expression.
Actual problem is determined by that there is no legislative basis for regulation of protection of invented characters.
